Terms of Service

1. About these terms

These terms apply to your use of tempzsoft.com and to the services TempzSoft (“we”, “us”) provides, including website design and development, web apps, hosting setup, security, SEO and ongoing care. By using this website or engaging our services you agree to these terms. If a written quotation or agreement for your project says something different, that document applies for that project.

2. Using this website

• The content on this website — text, designs, sample websites, graphics and our logo — belongs to TempzSoft. You may view and share it, but not copy or reuse it commercially without our permission.
• Sample websites, prices and figures shown on our service pages are illustrations, not offers or guarantees of results.
• Please don’t misuse the website — for example by sending spam, attempting to break its security or overloading it.

3. Quotations & agreements

• Every project starts with a written quotation describing the scope, deliverables, timeline and price. Quotations are valid for 30 days unless they say otherwise.
• Work begins once you accept the quotation (in writing or by email) and pay the agreed advance.
• Anything not listed in the quotation is outside the scope and will be quoted separately before we do it.

4. Payments

• Unless your quotation says otherwise, projects are billed as an advance to start, a part payment at an agreed milestone, and the balance before the website goes live.
• Prices are in Indian Rupees and exclusive of GST, which is added where applicable.
• Invoices are due within 7 days. We may pause work on overdue accounts.
• Online payments are processed securely by our payment gateway. We never store your card details.
• Third-party costs — domains, hosting, paid plugins, payment-gateway fees, SMS or email services — are charged at actual cost or as quoted, and renew on the provider’s terms.

5. What we need from you

To deliver on time we need your content (text, photos, logo, product details), access details and feedback within the agreed time. You confirm you own or have permission to use everything you send us, and that it is lawful. Delays in content or feedback may move the timeline.

6. Timelines & changes

• Timelines in your quotation are estimates made in good faith and depend on timely content and feedback.
• Each project includes the rounds of revisions stated in the quotation. Further changes, or changes after approval, are charged at our standard rate or quoted separately.
• When you approve the website for launch, we treat the project as accepted. Bugs found within 30 days of launch in work we built are fixed free of charge.

7. Ownership

• Once the project is paid in full, you own the final website design and the content created specifically for you.
• We keep ownership of our general tools, code libraries, templates and know-how, and give you a permanent licence to use them as part of your website.
• Third-party items (fonts, plugins, stock photos, software) remain under their own licences.
• We may show your project in our portfolio only with your permission. If you prefer privacy, we keep it confidential.

8. Hosting, domains & care

• Domains and hosting are registered in your name wherever possible, so they always belong to you.
• Care and support plans are billed monthly or yearly as quoted and can be cancelled with 30 days’ notice.
• We are not responsible for outages or data loss caused by your hosting provider or third-party services, but we will help you recover where we can.

9. Cancellation & refunds

• You may cancel a project at any time by writing to us. You pay for work completed up to that date.
• The advance is non-refundable once design or development has started, as it covers time already reserved and spent. If we have not started any work, we refund the advance less any third-party costs already paid.
• Payments for completed milestones, domains, hosting and third-party services are not refundable.
• Approved refunds are processed within 7–10 working days to the original payment method.

10. Liability

We build every website with care, but we can’t guarantee specific business results, search rankings or uninterrupted availability. To the extent allowed by law, our total liability for any claim relating to a project is limited to the amount you paid us for that project, and we are not liable for indirect losses such as lost profits or data. Nothing in these terms limits liability that cannot be limited under Indian law.

11. Confidentiality

We keep your business information, login details and data confidential and use them only to deliver your project. Personal information is handled as described in our Privacy Policy.

12. Governing law

These terms are governed by the laws of India. We will always try to resolve any disagreement by talking first; if that fails, disputes are subject to the jurisdiction of the courts where TempzSoft is registered.
